We here at East Brandywine Township want you to have a safe and legal 4th of July. There is a lot of conflicting information about fireworks out there, so we put together this quick primer on the law right here at home.

There are two types of fireworks, Display Fireworks and Consumer Fireworks.

  • Display Fireworks are those that you see during large shows--these are not available to the general public.
  • Consumer Fireworks are available to the public in many states but are illegal to use or possess in Pennsylvania unless you are a dealer. Within the universe of Consumer Firework products, the Commonwealth of Pennsylvania has specifically exempted some items. These are (1) ground and hand-held sparkling devices, (2) novelties, and (3) toy caps. So while in common vernacular and/or on product packaging these items are known as “fireworks,” here in in Pennsylvania these items are technically “non-fireworks” under state statute and are not regulated.

The illustration included with this article will help you differentiate between novelty items and other (illegal) Consumer Fireworks. The bottom line is that if it leaves the ground or is a firecracker, it is still illegal to possess or use in Pennsylvania and can be confiscated and a citation issued.

East Brandywine Township has a permitting process for Display Fireworks for public events like those hosted by the East Brandywine Fire Company. There is no permit process for private Consumer Firework use.

Finally, keep in mind use of “non-fireworks” such as sparklers, fountains, and novelty devices can cause severe burns and eye injuries. These products can also cause damage to buildings and cars and you could be liable for any injuries or damage resulting from their use.
